SUBMISSION OF DECLARATION

Providing information for your contribution

In accordance with the Fund Manager’s RFI, providers are required to access the following link in order to submit the information required to determine their annual Fund contribution (Declaration of Overseas Fee Income  - link can be accessed from Monday 25 February 2008 to Thursday, 20 March 2008). Providers are advised to read all sections relating to the 2008 contributions process prior to accessing this link.

On entering this site, providers will be required to enter their unique Fund Contribution PRISMS login code and security password. The Principal Executive Officer (PEO) nominated for each provider should have received their unique login and password details by mail with the Fund Manager's RFI in February 2008. PEO’s who have not received their login details should contact the Fund Manager. Providers need to complete all relevant details on the "Declaration of Overseas Fee Income" page including the following:  
  • details of actual overseas fee income for the period 1 January 2007 to 31 December 2007 by Tuition Assurance Scheme (TAS), Bank Guarantee, Indemnity Agreement and/ or Ministerial Exemption; AND
  • details of estimated overseas fee income for the period 1 January 2008 to 31 December 2008 by Tuition Assurance Scheme (TAS), Bank Guarantee, Indemnity Agreement and/ or Ministerial Exemption.
Providers with overseas fee income greater than $1 million, who are covered by a Ministerial Exemption, are advised to read the sections relevant to them in the 2008 Contributions Criteria. They are required to undertake specific additional procedures.

Registered providers with no overseas students or overseas fee income are
still required to submit a declaration.


The only providers who are not required to submit a declaration are those exempted by section 24(2) of the ESOS Act 2000. These include providers administered by a State education authority, or that receive Commonwealth recurrent funding for education, or receive course money in arrears, under a written agreement with the student.

Providers are advised to have the above information prepared prior to accessing the site as data cannot be changed once submitted unless the PEO contacts the Fund Manager.  Please note providers will only be able to login from 25 February 2008.

Provider declaration

Once all details on the "Declaration of overseas fee income" form have been completed to their satisfaction, providers are required to submit the form.  In doing so, providers will be declaring that the information provided is true and correct to the best of their knowledge.

Chapter 2 of the Criminal Code provides that giving false or misleading
information is a serious offence.


Providers are also advised that under section 26 of the Act, the Fund Manager is able to request registered providers supply information which is relevant in determining the amount of their contribution. Section 108 of the Act, further stipulates that it is an offence to provide false or misleading information in complying with this section. It should also be noted that the Fund Manager from time to time selects a sample of providers to be audited by the Fund Manager (or a representative) to ensure accuracy of the information provided.

Privacy of information

Providers are advised that all information submitted to the Fund Manager through the RFI process will be treated confidentially in accordance with the Privacy Act and will not be disclosed on a provider level to anyone other than DEEWR and the Contributions Review Panel.
